Disclamer
Graag wijzen wij u nog op onderstaande disclaimer zoals ook opgenomen in het document:

The document contains requirements as drafted by the ERTMS Programme to assist Vehicle Keepers (as defined in article 2, sub 21, EU Directive 2016/797) in their contracting process with suppliers. Vehicle Keepers should be aware and accept that these requirements should be made subject to a contract concluded with suppliers and that a contract will also need to be concluded to determine legal and financial aspects pertaining to the product and services to be delivered. As such, these requirements are not “stand alone” requirements and should be accompanied by provisions regarding (inter alia) change and acceptance procedures in order to ensure their effectiveness. Vehicle Keepers should note that they themselves are solely responsible for the necessary contracting process and that as a result thereof ProRail, as represented by the ERTMS Programme, assumes no liability (either directly or indirectly) in any form and/or manner (including, but limited to, liability leading to financial compensation) for the use and /or content of the requirements, any or all (necessary) changes made therein, and/or (perceived) omissions and/or errors unless otherwise expressly agreed upon in writing between Vehicle Keepers and ProRail. ProRail makes no warranties, expressed or implied, that compliance with the requirements will be sufficient to ensure safe systems of work or operation. The requirements have been drafted in light of the current state of affairs and developments. As such, ProRail, as represented by the ERTMS Programme, reserves the right to alter the requirements at any time if future developments so require, and/or for any additional reason whatsoever.
